Acceptable Use Policy

This Acceptable Use Policy (AUP) is an integral part of the General Terms and Conditions provided by Kayak Cyber LLC ("Us", "Our", "We"). By using Our Goods and Services, you ("Client", "You", or "Your") agree to comply with this AUP. We reserve the right to modify this AUP at any time, and the latest version will be posted on Our website. Continued use of Our Goods and Services after any such changes constitutes your acceptance of the revised AUP.
1. Prohibited Activities:
You agree not to use Our Goods or Services to engage in any of the following activities:
- Illegal Activities: Any activity that violates any applicable law, regulation, or ordinance, including but not limited to copyright infringement, trademark violation, fraud, theft, or the transmission of illegal content.
- Harmful Content: Creating, transmitting, distributing, or storing content that is defamatory, libelous, harassing, abusive, threatening, discriminatory, obscene, or otherwise objectionable.
- Security Violations: Attempting to probe, scan, or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization. This includes unauthorized access to or use of data, systems, or networks, including any attempt to interfere with the service to any user, host, or network.
- Spam and Unsolicited Communications: Transmitting unsolicited email messages, including spam, phishing attempts, or other forms of unsolicited communications.
- Malicious Software: Intentionally introducing viruses, worms, Trojan horses, or other harmful code or programs into Our or Your systems.
- Unauthorized Access: Accessing or using the accounts or systems of others without permission.
- Resource Abuse: Engaging in activities that consume a disproportionate share of system or network resources, potentially disrupting services for other users..
- Circumventing Security Measures: Attempting to bypass or disable any security features or protective measures implemented by Us.
- Misrepresentation: Falsely representing your identity or affiliation with any person or entity.
- Reselling Services: Reselling or sublicensing Our Services to third parties unless explicitly authorized in writing by Us.
2. Client Responsibilities:
- Security: You are responsible for taking reasonable measures to protect your account credentials, including choosing strong passwords and protecting your login information. You are also responsible for promptly notifying Us of any suspected unauthorized access to your account.
- Data Backup: As stated in Our General Terms and Conditions, you are solely responsible for backing up your programs and data. We are not liable for any program or data loss.
- Software Licenses: You are responsible for ensuring that you have all necessary licenses for any software used in conjunction with Our Services. This may be purchased through Our Services or via a Third-Party.
- Compliance: You are responsible for ensuring that your use of Our Goods and Services complies with all applicable laws and regulations.
3. Monitoring and Enforcement:
We reserve the right to monitor the use of Our Goods and Services to ensure compliance with this AUP. We may investigate any suspected violations of this AUP and take appropriate action, which may include, but is not limited to:
- Issuing warnings.
- Suspending or terminating your access to Our Goods and Services.
- Reporting illegal activities to law enforcement authorities.
- Taking legal action to recover any damages or costs incurred as a result of the violation.
We will make reasonable efforts to notify you of any action taken in response to a violation of this AUP, but we reserve the right to take immediate action without notice if deemed necessary to protect the integrity and security of Our systems and services or the rights of others.
4. Reporting Violations:
If you become aware of any violation of this AUP, please notify us immediately by contacting us through the methods outlined in Appendix A of Our General Terms and Conditions.
By using Our Goods and Services, you acknowledge that you have read, understood, and agree to abide by this Acceptable Use Policy. Failure to comply with this AUP may result in the suspension or termination of your services.
